Dwight Steward provided an analysis rebutting the EEOC’s statistical analysis in a race-based failure-to-hire lawsuit. Dr. Steward demonstrated that the employment data relied upon by the EEOC in its analysis was of questionable quality and was incomplete. His research also revealed that the comparison hiring pools used by the EEOC were inappropriate and not applicable to the firm’s actual employment hiring pool. He also uncovered several methodological flaws in the EEOC analysis resulting from its failure to incorporate key hiring factors such as degree of job interest.
